Amy Thompson Photography — Brand & Commercial Photography

These terms apply to brand, commercial, and business photography services booked through Amy Thompson Photography ("Photographer"). By booking a session, you ("Client") agree to the terms below.

Booking & Payment

A signed contract and retainer are required to hold a shoot date. The remaining balance is due per the schedule outlined in your project agreement, generally on or before the day of the shoot unless otherwise arranged in writing. Projects are not considered confirmed until the retainer is received.

Rescheduling & Cancellations

Life and business schedules shift — if you need to reschedule, give as much notice as possible and I'll work with you to find a new date, subject to availability. Retainers are non-refundable but can typically be applied to a rescheduled date within 90 days. Cancellations made less than 7 days before the shoot forfeit the retainer.

 Usage Rights & Licensing

Amy Thompson Photography retains copyright of all images produced. Your contract will specify the usage license granted for your project — for example, rights for web, social media, print advertising, or a specific duration or campaign. Usage beyond the scope of your agreed license (such as resale, third-party licensing, or use by another company) requires a separate agreement and fee.

Deliverables & Turnaround


Edited images are typically delivered within the timeframe stated in your contract, via an online gallery. Rush delivery may be available for an additional fee. Raw, unedited files are not included in any package unless specifically negotiated in advance.

 Revisions

Minor edits (color correction, cropping, retouching adjustments) on selected images are included as outlined in your package. Requests outside that scope, or edits requested after final delivery, may incur additional charges.

 Model Releases & Third Parties

If your shoot includes employees, models, or other individuals, it's the Client's responsibility to obtain any necessary model releases or consent for those individuals to be photographed and for the resulting images to be used per your license. Amy Thompson Photography is not liable for claims arising from a failure to secure proper releases.

Portfolio Use

Unless your contract states otherwise, Amy Thompson Photography retains the right to use images from your shoot for portfolio, marketing, and promotional purposes, including on this website and social media.

 Liability

Amy Thompson Photography carries reasonable care in delivering services but is not liable for delays or losses due to circumstances beyond reasonable control (illness, extreme weather, equipment failure, or other events outside the Photographer's control). In the rare case a shoot cannot be completed or delivered, liability is limited to a refund of fees paid for the specific undelivered service.

Governing Law

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Severability

If any part of these terms is found invalid or unenforceable, that part will be limited or removed to the minimum extent necessary, and the remaining terms will stay in full effect.

Entire Agreement

These terms, together with your signed project contract, make up the entire agreement between Client and Photographer for the services described, and supersede any prior discussions or proposals not reflected in the signed contract.

 Changes

These terms may be updated periodically; the version in effect at the time of your signed contract governs that project.
